The Challenge of
Daibiru’s First International Expansion
Difficult Contract Negotiations with JHG
Although Daibiru had gotten used to negotiating contracts in English due to its Vietnam operations, the contract negotiations with the lawyers hired by JHG were a tough challenge, unlike anything the company had experienced before. Daibiru hired lawyers from Clayton Utz, one of Australia’s six largest law firms, to negotiate, but the other side took a stubborn hardline stance and attempted to secure preferential terms in every aspect of the deal. The contract was over 500 pages in length, and it required considerable time to understand the entire thing.
After about a month of being in the conference room from morning to night with endless negotiations, a relationship of trust between the two parties strangely began to develop, and the contract fell into place spontaneously. In August 2018, Daibiru signed a land purchase agreement and a development management agreement with JHG, marking our first foray into Australia.
